An article in the Law Society Gazette has today confirmed the order of the court in the case of Aviva Insurance Ltd v Oliver.
In the Aviva case, the Defendant was found guilty of buying information relating to road traffic accidents, with injured drivers or passengers, which he knew to be wrongfully obtained. Oliver sold the data to Case Management Companies- you know, the annoying types that ‘phone you from an anonymous, or far away number, and ask ‘Mr Smith? We believe you have been injured in a road traffic accident that wasn’t your fault. Is this correct?’ At which the majority of us get annoyed and put the ‘phone down.

Here’s to the good news- The Claimant, Aviva, pursued Mr Oliver for damages. In January 2017, Mr Oliver pleaded guilty to an offence under the Data Protection Act and was fined and made subject to a confiscation order. The Claimant, Aviva then started civil proceedings against Mr Oliver for, alleging breach of confidence, conspiracy and an inducement of the Aviva employee to breach her contractual obligations.
The outcome? Well, the court found that they did believe that Mr Oliver knew that the information relating to those injured was not legitimately obtained, and he was ordered to pay Aviva £190,000.00 in damages.
