Many of our recent Lasting Power of Attorney Solicitors' clients will be aware of the ever-frustrating delays experienced by the Office of the Public Guardian in registering Lasting Powers of Attorney. Our Lasting Power of Attorney Solicitors in Longridge can recall when, pre-COVID, the wait time was around 6 to 8 weeks. Now, clients of our Longridge Solicitors are advised that the Office of the Public Guardian's current timescales are around 26 weeks. Can Lasting Power of Attorney applications be expedited? 

Our Solicitors in Longridge are asked this question by many of our Lasting Power of Attorney clients. Unfortunately, the Office of the Public Guardian does not offer a service for speeding up applications. Our Lasting Power of Attorney Solicitors would simply advise that the best way to ensure that your Lasting Powers of Attorney are registered when you need them, is to make them when needing them is only a distinct possibility.  
 
For example, if you own property or have money in the bank, but you are perfectly healthy and do not require assistance with your finances, make Lasting Powers of Attorney. Once registered, you can put them away and not use them unless you do require help in the future.  
 
As long as you have capacity, the documents cannot be used without your authority. In addition, you always have the option of revoking the documents- either partially or fully- if you feel that they no longer meet your requirements. 

What is the process for making Lasting Powers of Attorney? 

Firstly, when you contact our Lasting Powers of Attorney team, we would discuss your requirements via email or over the 'phone, before arranging an appointment with you to take your full instructions, as well as discussing any specific instructions or preferences you may wish to include in your Lasting Powers of Attorney.  
 
Our Lasting Power of Attorney Solicitors would then arrange to send you our initial paperwork, confirming your instructions. If you are happy to proceed, you can simply sign and return one copy of the paperwork. We will prepare your Lasting Powers of Attorney, and we can then arrange an appointment for you to sign the final documents. 
 
Once you have signed, your attorneys will also need to sign, so we can either send the documents to them, or arrange for them to attend their local office- Garstang, Lancaster, or Longridge- to meet with a member of the team to sign. 
 
After all parties have signed the Lasting Powers of Attorney we will submit them to the Office of the Public Guardian to be registered.

How much do Lasting Powers of Attorney cost? 

At MG Legal, we like to be upfront about our costs. We offer Lasting Powers of Attorney on a fixed-fee basis, as follows:-  
Financial Decisions and/or Health & Welfare Decisions 
Legal Fees 
30 to 60 minute appointment to discuss your requirements for your LPA and to ascertain capacity 
 
Preparation of the LPA, and making any amendments (as required) 
 
Attendance upon you to go through and complete your LPA, including giving any advice required 
 
Sending the document to your Attorney(s) for signature 
 
Sending the document to the Office of the Public Guardian for registration 
 
Arranging for collection/posting of the original LPA following registration 
One Lasting Power of Attorney (i.e. Health or Financial LPA for one person) - £300.00 + VAT 
 
Both Lasting Powers of Attorney (i.e. Health and Financial LPAs for one person) - £450.00 + VAT 
 
Four Lasting Powers of Attorneys (i.e. a couple making both types of Lasting Power of Attorney) - £750.00 + VAT 
 
 
The Office of the Public Guardian charge a fee to register the documents. This fee has increased and decreased over the years, but it currently sits at £82.00 per document, unless you qualify for a fee remission or exemption.
