Injured in an accident caused by a spillage or debris in the road 

Similarly to road defects such as pothotes, motorcyclists are at a much greater risk of being involved in a road traffic accident and obtaining injuries due to debris on highways. The UK highways authorities are responsible for keeping up the safety and quality of our roads. However, when it comes to debris from road traffic accidents and other events, they do not take responsibility. It is up to those involved in the accident to clean away any debris that they may have left in the road. However, if there are multiple parties involved and people have sustained injuries, then the local council, or even the emergency services, may be contacted to clear the area.  
 
However, this is not always the case. Many small-scale road traffic accidents involving only one car go unreported, and those involved often drive away from the scene without taking the time to look for any potential debris left at the scene. This is especially common in accidents that have taken place when nobody else was around, such as at night, or when the driver involved was breaking other laws such as speeding or driving under the influence.  
 
When this happens, along with when other events take place such as oil spillages in the road, it makes it much more likely that another accident will take place as a result of the debris or spillage. It is not uncommon that this second accident will affect a motorcyclist rider, due to their increased vulnerability on the road and inability to avoid obstacles.  

How do I make a personal injury claim for accidents caused by spillages or debris in the road? 

Personal injury claims involving spillages and debris can often be more complex and confusing that regular personal injurt claims. This is because it is often not known who the other party involved is that left the debris or caused the spillage. If the debris was located in an area which is covered by CCTV cameras, the this can help to indentify the other person involved, but this is not often the case. 
 
For events such as this, the Motor Insurers’ Bureau (MIB) was set up. This is an organisation that was intiially set up buy the government and is now ran and paid into by the insurance companies. The MIB is essentially in place to ensure that victims of road traffic accidents in which the liable party is unknown are still provided with proper compensation. They also provide the same service for cases in which the liable party is uninsured or cannot be traced. The process for making a claim against the MIB is pretty much the same as that of making a claim against an insured, regular driver. 
 
However, the processes by which the claim is raised, and how it is argued, is slightly more complex as there is no other driver involved. Leg injuries- In moderate injuries to the legs, consisting of multiple fractures, or severe crushing injuries to one leg, our personal injury specialists have seen amounts of £26,050 to £36,790 awarded. 
 
Back Injuries- Due to the unsupported impact that motorcycle riders often experience in accidents, back injuries can often occur. For minor injuries which are short-term and temporary in nature, claimants can be awarded up to £11,730. 
 
Mderate back injurues which manifest as long-term problems and continuous pain can acheive rewards of £11,730 to £36,390, while those that cause motor issues and loss of function can bring in £36,390 to £151,070. 
Head injuries - Unfortunately, head injuries are fairly common in motorbike accidents. They range from minor concussions and cuts to fatal skull fractures and brain damage. Injuries to the head that have not caused any brain damage can achieve compensatory awards range from £14,380 to £40,410. 
 
Those that have caused moderately severe brain damage tend to award around £205,580 to £264,650. While compensation for accidents and injuries resulting in severe cases of brain damage, in which the claimant will be unresponsive and will be in a vegetative state, can range from £264,650 to £379,100. 
 
Hand Injuries – Our hands are arguably the most important functioning parts of the upper limbs. The Judicial Studies Board recognises this, and with this in mind, the loss of a hand is valued not far short of the amount which one of our injured clients would be awarded for the loss of their arm. 
 
The total or effective loss of both hands, rendering your hands as almost no use, is valued at between £132,040 and £189,110. This sum is for the personal injury aspect of the claim, alone, and does not include the obviously large sums for lost earnings, care costs, house renovations and changes, travel expenses, and medical expenses. 
 
Facial Injuries – a serious fracture, or multiple fractures, to the nose requiring an operation to enable the injured person to breathe, and leaving a degree of cosmetic deformity, would attract an award of £9,990 to £21,700. 
 
The figures are rather wide for any facial cosmetic injury as it is one of the areas the judiciary has decided that an injured person's age and sex have an impact on the amount of personal injury compensation. Younger people, in their early 30’s and younger, are usually awarded more compensation for injuries resulting in scarring and deformity.
