Can I claim compensation if I was on a package holiday?
If your holiday is booked through a UK travel operator, either online, or in the travel agents in town, and you booked your flights and accommodation at the same time, then the chances are you have booked a package holiday. How long do I have to make a claim?
If you suffered an injury on holiday in the UK, then you usually have a period of 3 years from the date you were injured, or the date upon which you became aware that somebody else’s negligence was the cause of your personal injury. However, there are lots of countries in the world, and they do have different times limits within which to pursue a claim for injury compensation. If your accident was in the UK, then you are safe in the knowledge that you have 3 years to claim. If you were injured whilst holidaying an a cruise ship, The Athens Convention has a time limit for which you can bring a claim. The time limit is normally two years from the date of disembarkation (getting off the ship). The Montreal Convention 1999 states that you have 2 years to make a claim for personal injury from the date you were injured on an aeroplane.
