Mediation didn't work, what happens now? 

If mediation has not worked, the other parent is unable or unwilling to attend, or does not respond, then the mediator will sign off the relevant page of your application form, and the form or forms can be completed and sent to the Court for issuing. The Court is likely to reject any application where the mediation referral has not been made, unless there is the appropriate evidence for exemption. It should also be noted that many mediators charge a fee for the mediation certificate.
