X-ray Negligence Claims Solicitors
X-rays are vitally important in the diagnosis of a number of medical conditions, and allow the correct treatment to be offered to patients in order to limit the severity and pain of their illness or injury.
While many consider X-rays to be standard medical procedure, offering reliable results, negligence by medical professionals can lead to misread X-ray results, delayed X-ray scans, and even failure to offer an X-ray where one should have been carried out.
If you have suffered from further illness or injury due to X-ray negligence of any kind, then get in touch with MG Legal’s NO WIN NO FEE medical negligence solicitors today, here.
Have you experienced radiology negligence in the last three years?
What are X-rays used to diagnose?
X-rays are quick and effective procedures used to easily produce high-quality images of inside the body. They use a type of radiation that can’t be seen or felt, making them completely painless.
X-rays can be used on most parts of the body, and while they are traditionally thought of to diagnose fractures and broken bones, they are useful in diagnosing and highlighting a number of different medical problems.
These include:
Dental issues, such as abscesses, loose teeth, and impacted teeth
Bone tumours, both cancerous and non-cancerous
Heart problems and heart failure
X-rays are a key part of medical diagnosis for a large number of medical issues and problems. If a patient visits a medical professional displaying symptoms of these issues, an X-ray is necessary to quickly and properly diagnose them.
What is an X-ray negligence claim, or an X-ray misdiagnosis claim?
There are a number of different negligence claims that can be made by patients regarding the use of X-rays by medical professionals. These include:
A medical negligence claim for the failure to take an X-ray- if you have visited your local GP or hospital displaying symptoms of a medical issue that requires an X-ray for diagnosis, and are not offered an X-ray in order to examine this possibility, then you could make a medical negligence claim for X-ray negligence
Delayed X-ray claim- from the time that you first visit a medical professional displaying symptoms of any of these conditions, you should be offered an X-ray appointment within six weeks, as stated by NHS guidelines. If this is not the case, and you face delays in your medical diagnosis, leading to delayed treatment and the worsening of your injury or illness, then you could make a delayed X-ray medical negligence claim.
X-ray misdiagnosis claim- the third type of X-ray negligence claim that our medical negligence solicitors specialise in are X-ray misdiagnosed claims. In these cases, the X-ray was completed properly and on time, but was misread or mis-interpreted by the medical professional, known as a radiographer, who is analysing the results. If this occurs, and leads to a missed diagnosis of a medical issue, or a misdiagnosis of an incorrect medical issue, you could make a medical negligence claim for financial compensation, or a radiology negligence claim.
Is there a time limit on making an X-ray negligence claim?
Medical negligence claims are subject to the Limitation Act of 1980, which states that patients have 3 years from the date of negligence to file a medical negligence claim for financial compensation. This assumes that the act negligence was clear and obvious at the time, which is not always the case. If you only become aware of the medical negligence that occurred at a later date, then you instead have three years from this date of knowledge to make your medical negligence claim. Exceptions can apply for minors, in that this three year time period only begins on the date of their eighteenth birthday to make a claim.
While these time limits are in place, and may seem generous to many, our specialist medical negligence solicitors would always advise our clients to get in touch with a solicitor as soon as possible, and begin building a medical negligence claim. No two claims are the same, and there is no telling it will take our expert solicitors to build your claim to be as strong as possible.
