What can I claim for if I have been hit by a motor vehicle?

Pedestrians are one the of the most vulnerable user groups, along with motorcyclists, horse riders and cyclists. Often hard to see on the road, and not having the protection afforded by those driving in a car, pedestrians, horse riders and cyclists are particularly vulnerable to injuries and accidents.

If you are a pedestrian and have injured by a motor vehicle, quite often your injuries can be life-changing, and include broken arms, legs, head injuries, or sadly, even death. If you have been injured you can make a personal injury claim, but you can also claim for any other losses you have sustained. Examples include damage to clothing, your mobile telephone, broken spectacles, watches and jewellery, in addition to medical treatment costs, lost earnings, including future loss of earnings if you are badly injured and cannot continue to carry on working. If your injuries have caused you to be in financial distress, then our personal injury solicitors can request an interim payment in settlement of your claim for personal injury compensation, before your matter concludes.

How do I make a personal injury claim if I have been hit by a car or motorcycle?

If you are a pedestrian and have been injured by a collision with a motor vehicle, in the last 3 years, and the incident was not your fault, then the first thing to do is make contact with MG Legal’s road traffic accident personal injury team. The advice we give you will be straightforward, honest, easy to understand, and we’ll let you know, there and then, if we can accept your personal injury claim on a no win no fee basis.

When bringing a claim for personal injury compensation, it is for you, the injured person, to prove that it was the vehicle driver’s fault, and that they acted negligently. Our road traffic accident solicitors have seen every situation before, and the circumstances themselves often confirm who was at fault; we have found that only in very rare circumstances are pedestrians at fault, and the accidents often occurs as a result of a car not seeing the pedestrian, or by two vehicles colliding, and one, or both vehicles, coming off the road, and injuring innocent pedestrians who just happen to be in the vicinity.

In order to pursue a claim, as a pedestrian, more often than not you will need the following information:
The registration number of the vehicle at fault
The name of the driver of the motor vehicle
A police reference, if the police were called, and attended the scene of the accident
Witness details, if the incident was witnessed.

However, if you did not manage to obtain the vehicle details, or obtain the name of the driver of the motor vehicle that collided with you, then all is not lost, as MG Legal's expert road traffic accident solicitors will be able to pursue a claim through the Motor Insurers’ Bureau. The Motor Insurers Bureau is available to anyone who has suffered vehicle damage, or non-fault personal injury after a road traffic accident, and the driver of the vehicle at fault for the road traffic accident does not have a policy of insurance in place.

The Motor Insurers’ Bureau offers two schemes: Traced, and Untraced. If you do not obtain the vehicle registration number of the vehicle that hit you, but the police attended the scene, and you went to hospital or your GP, as a result of the injuries sustained, then MG Legal would submit your claim for pedestrian injury compensation, to the Motor Insurers’ Bureau, and request that your claim is accepted on the Untraced Agreement, in any event.

How can MG Legal help me to claim personal injury compensation as an injured pedestrian?

If you contact, or come in and see us at any of our offices, then the first thing our personal injury experts would do, is to take full, detailed instruction from you, including how the accident happened. All claims that we accept, are subject to a No Win No Fee agreement, and all that we ask is for you to complete one of our Claim Forms, enabling us to submit your claim to the insurance company of the driver that caused the accident, and for you to be injured. The insurers have 21 days to respond to our personal injury team, confirming that liability has been accepted, or indeed, denying that the accident occurred in the manner suggested, or at all. Subject to our personal injury team being happy with your version of events, a medical appointment would be arranged, subject to Part 35 of the Civil Procedure Rules 1998, and we would value the amount of personal injury compensation you are to receive, and commence settlement negotiations, including any other losses you have sustained, such as lost earnings.

The first thing to do if you require the best advice from highly-qualified personal injury experts, is to contact our team and we will walk you through the process. As we always say to our injured clients, if you have any questions, just feel free to ask.

How much is my personal injury claim worth?

As they are not protected by anything other than the clothes they are wearing, pedestrians offer suffer some of the worst injuries that our road traffic accident solicitors have seen. Our team have dealt with the families of pedestrians who have been unfortunate enough to die as a result of their injuries, or suffer catastrophic injuries to the neck, back or spine, and render them unfit to work ever again.

The Judicial Studies Board Guidelines, caters for all injuries and accidents, trauma and psychological damage arising out of a road traffic accident, and damages, obviously vary, depending on the area of the injury, the effects of the injury on our clients everyday life, and work life, and if they are psychologically distressed, it is far from unusual for our clients not to be psychologically injured after being hit by a motor vehicle, with a fear of being a pedestrian, or even leaving their own home, in case they suffer such an accident again.

So, how much is my claim for personal injury worth? This is a common question we are asked and the truth is that until we have full medical evidence, we can’t be totally sure. Personal injury claims are evidenced primarily in a report from a medical expert, in cases where a pedestrian has suffered a personal injury, it is likely that we would instruct an orthopaedic surgeon, a cosmetic surgeon, and potentially a psychologist if you have psychological symptoms. This evidence is then assessed by our specialist personal injury solicitor using, amongst other things, the Judicial Studies Board Guidelines, known as the “JSB”. The JSB is a regularly updated reference book, containing ranges of awards for all types of injuries based on recent awards at Court. This book can be found on the desk or in the briefcase of any solicitor, barrister or Judge and is the first port-of-call when assessing claims for personal injury. This aspect of your claim is known as General Damages, it is your compensation for the personal injury you have suffered.

The remainder of your claim is called Special Damages; an award for the money which you have paid out because of the negligence or have lost out on. So, amongst these losses would be additional medical expenses, travel costs, care costs and future treatment costs for both necessary and cosmetic work. Also included would be any lost earnings due to absences from work.

Together these losses form a “global” settlement which MG Legal’s expert solicitors will ensure is appropriate for your claim before you decide to agree settlement. If you believe you have lost money, or paid out unnecessarily as a result of being injured as a pedestrian, tell one of MG Legal's expert pedestrian injury claim solicitors and they will seek remibursement from the negligent motorist's insurance.

The ultimate aim of this process is to restore any losses or expenditure and then, as the injury cannot be “undone”, to award you an amount of money to compensate you for the pain, suffering and loss of amenity caused by the negligence.
