A man falling backwards off a ladder onto the floor
Over the past few years, any mention of personal injury in the news generally heralds another “crackdown” on claims or a change to the legal process which penalises the injured party or your local personal injury solicitor. MG Legal, your local personal injury solicitor, are pleased to write about something more upbeat, which is good news for you and your personal injury claim. This relates to a question that many people ask which is “how much is my claim worth?”.

When valuing personal injury claims, your local personal injury solicitor, including MG Legal, will often refer to a book known as the “JSB”. The full title of the book is the “Judicial College Guidelines for the Assessment of General Damages in Personal Injury Cases”. The JSB provides guidance to solicitors, barristers and indeed to Judges about the value of every conceivable type of injury.

As everyone knows, over time inflation increases the value of everyday items and services and so, in line with this awards for injuries are increased at the same time. The new “JSB” was released last week, a little over two years since the last edition and on review here at MG Legal, your local personal injury solicitor, we have found that the value of awards has generally increased by around 7%. Whilst this is not simply a solid guarantee of a 7% increase on any valuation issued, this is a general guideline and so, if your claim has not yet been agreed, there is a prospect of increasing the award you might receive. The increase is also above the rate of inflation over the same period and so the increase means that your personal injury claim is now, on average, worth more in real terms.

MG Legal, your local personal injury solicitor, handle a variety of claims of various values and so, whilst 7% might not sound like a lot, even in a relatively lower value claim worth £1500.00 in, say, August 2019, the average increase in value is £105.00. As the value of claims increases, the effect in terms of compensation increases proportionately and so, claims valued in the tens of thousands can gain a significantly higher value.

This is, for once, good news for Claimants who are midway through their personal injury claim as it also offers a greater chance of obtaining a better final settlement and also, with the increase in value, increases the chances of bettering any offer the Defendant might have previously made. This reduces the risk of later costs consequences which, at MG Legal, your local personal injury solicitor, we know can be a huge factor in the way any given claim can settle.
