How do I make a claim for my car accident injuries?
Posted on 18th January 2018
When you are injured, whether at the hands of another road user, by a slip, trip or fall, or through an accident at work, it can seem like your world has been turned upside down. Don't worry, because at MG Legal, we are here to help. Our in-depth guide below will tell you all you need to know to maximise your claim for compensation. Read on, and get in touch with our expert Personal Injury Team, if we can help you get the damages you deserve.
When you are injured, the last thing on your mind will be taking pictures or keeping receipts. However, when claiming compensation for your Personal Injury, these things are of paramount importance- I mean, who wants a 'he said, she said' situation, or you to miss an important piece of information, when you can just take pictures at the scene, and save yourself lots of time and trouble later? The more information you can obtain at the scene of the incident, the better.
So, for example, if you are unfortunate enough to have tripped in the street, then images of the defect, be it a raised flag, a pothole, or a hole in the Tarmac, would assist your claim massively. If you are in a Road Traffic Accident, then the name of all parties involved, and pictures of the vehicles in situ, could be vital to the success of your claim. You get the picture, right? Basically, a picture is worth a thousand words, and this is no exception when you're making a claim for personal injury, and trying to maximise your compensation.
Not limited to just pictures, there are other ways that you can maximise your compensation, such as:
The clue is in the name- you are after all, making a claim for personal injury. So, this is where we start: with our damages calculation. Whether you've suffered a sprained neck in a road traffic accident, or been the victim of a surgeon's negligence, at MG Legal, we start your claim by getting you to the best-qualified expert in their field, to assess your injuries, and prepare a report so we can negotiate settlement as soon as possible. There are no delays, no wasting of time, and you are covered by our Conditional Fee, 'No-Win- No Fee' Agreement.
Loss of Earnings
A big loss that many people do not always consider when claiming compensation is any loss of earnings. Employers have a right to reduce an employee's wages to Statutory Sick Pay (SPP) if they are off work ill for 4 or more consecutive days (including non-working days). SPP is currently paid at the rate of £92.05 per week for up to 28 weeks.
In order to prove that you had suffered a loss of earnings, or to claim the difference in your wages back on behalf of your employer, you will need to prove that you have suffered a reduction in your pay. One way of showing this would be to provide pay slips to the defendent's insurers. For example, our expert team of solicitors would usually request that you provide us with 3 months' of payslips before the accident, a payslip for every month that you have had reduced pay, and 3 months' of payslips following your wage increasing to your full pay again.
Travel and Parking Expenses
The point of compensation in a Personal Injury Claim is to put you back into the position that you would have been in should the accident have not occured. For example, if you had an operation that should only take one day trip to the hospital, you would reasonably expect to pay for one trip there and back, and/or one day's parking. However, if the operation was not correctly carried out, you may have another operation (or another 3 or 4!) to correct the damage. This can mean that you now have the added expense of the additional trips and parking. Our expert team of Medical Negligence and Personal Injury Solicitors can help you to claim this back so that you're not out of pocket for something that wasn't your fault.
If you are perscribed medicine to help the healing process of your injuries, including physiotherapy or medicines, the cost of such medicine and procedures could be claimed back from the third party.
