The building site injury: 

When Morgan Prosser was using a petrol-powered disc cutter on a Cornwall building site earlier this year, the blade of the saw ‘kicked up’ and left him with a serious laceration on his arm. After several months of operations and treatment, in a bid to save his arm, Prosser eventually had to have his arm amputated due to the ongoing injury. 

Who is to blame for building site accidents like this? 

As is the case with all workplace accidents causing serious injury to employees, Health and Safety Executive (HSE) then carried out an investigation into the accident, and how the injury occurred, finding that a number of negligent actions were carried out by the building site contractors. 
 
Inadequate training- Mr Prosser was not provided with sufficient training in the use of the industrial disc cutter. No risk assessment- Another negligent act that was taken by the building site contractors was their failure to carry out necessary planning or risk assessment of the use of the disc cutter on the site. After this investigation, and the HSE finding that the contractor company in charge of the building site had acted negligently, the case went to court.  
 
This led to a trial at the Truro Crown Court, where the HSE fined the contractor company £250,000 for negligence.
