What is a leg injury compensation claim?

When we first think of a leg injury, most people’s minds first go straight to the thought of a broken leg. However, there are a huge number of different leg injuries that the human body can face, ranging from serious life-changing injuries to minor ones.

These include:-

Loss of leg(s)- a life-changing injury, and one that will have complex outcomes with regard to future employment, lifestyle and general health.

Fractures- there are a number of fractures that can occur to the legs, including stress fractures, displaces fractures, compound fractures, and other kinds of fractures. All of these require medical attention, and people can often need long-term treatment to fully recover.

Sprains and strains- while generally less serious than fractures, and requiring a much more reduced recovery time, sprains and serious strains to any part of the leg can be extremely painful, and can greatly impact on your routine.

Cuts and other lacerations- Many leg injuries to the bone or muscle may be accompanied by serious cuts and other lacerations. These can be the main injuries but also often come as secondary injuries to a more major injury.

Types of leg injury claims:

Road Traffic Accidents- from the more serious injuries more often found in pedestrian road traffic accidents, motorbike road traffic accidents or cyclist road traffic accidents, to the common “whiplash” soft tissue injuries many occupants in cars suffer from.

Accidents at Work- Whether a result of faulty machinery or other equipment, a poor system of work, lack of training, inadequate Personal Protective Equipment (PPE) and breaches of the Manual Handling Regulations, many different injuries, both serious and minor, can occur in the workplace. This type of claim can also include situations where you develop leg symptoms over a period of time due to poor working systems or conditions.

Public Liability incidents, such as slipping and tripping incidents, can cause injury to the legs as often a fall is unexpected and many surfaces, whether pavements, supermarket floors or other public premises have hard floors. It is common for people to strain and pull muscles trying to regain their balance and so, even if you do not actually fall, it is still possible to sustain a lower limb injury.

Criminal injuries; where due to an assault or other criminal act, you suffer an injury -the Criminal Injuries Compensation Authority (CICA) route is slightly different but can still be pursued on a no win no fee basis. See a full overview of the process, here.

Whatever the circumstances, if you believe you have sustained a leg injury that was due to someone else’s negligence, you are most likely entitled to make a claim for personal injury compensation. MG Legal’s team of experienced personal injury solicitors are ready to help you and we will always look to have the ball rolling the same day, with all accepted claims handled on a no win no fee agreement basis so that you do not have to worry about funding your legal representation at the same time as dealing with the pain and difficulty caused by an injury.

What is the average payout for leg injury claims?

The two deciding factors in any personal injury claims is the severity of your injury and the amount of time that it will take to recover. As with every injury, and every personal injury claim, is completely unique, it is impossible to accurately predict the value of financial compensation that your claim particularly will achieve.

However, our specialist personal injury can offer some guidance with reference to the Judicial College’s 15th edition guidelines, giving guidance on the personal injury settlements. We must also remember that these values cover the compensation available for the injury alone, and do not stand for any further possible payments for special damages, such as any loss of earnings and travel costs.
Leg Injury:
Potential Compensation:
Amputation or loss of both legs- where both legs are lost above the knee, or one at a high level above the knee and one below the knee.
£225,960 to £264,650
Below the knee amputation of both legs- this varies depending on the level at which the legs are amputated.

£98,380 to £129,010
Below knee amputation of one leg- varying based on complications, associated pain levels, associated psycholigcal problems and the success of any prosthetics used.

Severe leg injury- in the most severe cases short of amputation.
£90,320 to £127,530
Very serious leg injuries- those leading to permanent problems with mobility and requiring crutches of mobility aides long term.

Are there time limits for making leg injury claims?

Generally speaking, you are able to pursue a compensation claim for any injuries or illnesses that are not your fault. Subject to the Limitation Act of 1980, you have until three years after your injury to pursue a personal injury claim. This date will start

There are some exceptions in place to this rule for both minors and those who are pursuing the claim on behalf of a loved one with limited mental capacity. Where children have suffered harm or personal injury, the limitation period will not start until a child’s eighteenth birthday so even if you suffered an injury whilst you were being born, you have until the age of 21 to claim compensation. The reason for this exception is crucial in allowing time for the true extent of an injury to a child is known.
