How long will my divorce take?
This will be on a case by case basis. If your spouse engages with the Court, returns paperwork as and when requested, and there are no significant delays with the Court, then the whole process can be completed within 6 – 8 months. However, if the other party does not engage with the proceedings and additional procedures and applications are needed, then this will take longer. It should also be noted that different Courts can have different timescales, as does the on-line divorce system operated by the Court. The above estimate has been calculated using the North West Regional Divorce Unit at Liverpool Family Court which appears to be one of the more speedier ones!
A petitioner will also be advised in many cases to delay applying for the final decree, decree absolute, if financial settlement has not been concluded. No longer being someone’s spouse can affect entitlement to assets such as pensions and policies. Advice on whether to apply at the earliest opportunity will be provided on a case by case basis.
