Can a Civil Partnership be annulled?
As with marriage, the civil partnership can be annulled but there are fewer reasons on which to base an application for nullity.
A civil partnership can be annulled if any of the following apply :-
(a) Either party did not validly consent – ie they were forced or pressured or were incapable of giving consent
(b) Either party was suffering from a mental disorder which would render them unfit for civil partnership
(c) The respondent (ie the person against whom the application for nullity was brought) was pregnant at the time that the civil partnership formation occurred by someone other than the person with whom they entered into the civil partnership
(d) If an interim gender recognition certificate has been issued to either party after the formation of the civil partnership
(e) If a full gender recognition certificate has been issued as at the date of the civil partnership to the respondent
